Welcome to Unapologetic Nomads LLC – “Travel With the Nomads” Terms of Service:
These Terms of Service (“Terms”) govern your use of our travel services, including booking, payment, and participation in our travel packages. By booking a travel package with Unapologetic Nomads LLC, you agree to these Terms. Please read them carefully.
1. Definitions
“Company,” “we,” “us,” or “our”refers to Unapologetic Nomads LLC.
“Customer,” “you,” or “your” refers to the individual booking or participating in a travel package.
“Travel Package” refers to the travel and tourism services offered by the Company, including accommodations, transportation, tours, and activities.
2. Booking and Payment
1. Booking Process: To book a Travel Package, you must complete the booking form on our website and provide all required information. Bookings are subject to availability and are not confirmed until you receive a confirmation email from us.
2. Payment: A deposit is required at the time of booking, with the remaining balance due [30] days before the departure date. Payments can be made via credit card, bank transfer, or other methods specified on our website.
3. Cancellation by Customer:
If you need to cancel your booking, you must notify us in writing. Cancellation fees apply as follows:
– More than 60 days before departure: [30%] of the total package price.
– 30-59 days before departure: [50 %] of the total package price.
– Less than 30 days before departure: [70%] of the total package price.
4. Cancellation by Company:
We reserve the right to cancel any Travel Package for any reason, including but not limited to insufficient participants or unforeseen circumstances. In such cases, you will receive a full refund of all payments made to us.
3. Travel Documents and Requirements
1. Passports and Visas: It is your responsibility to ensure that you have a valid passport and any necessary visas for your destination. We are not responsible for any issues arising from failure to obtain or maintain these documents.
2. Health Requirements: You must meet all health requirements for your destination, including vaccinations and medical precautions. Consult your doctor and relevant authorities for up-to-date health information.
4. Changes to Travel Packages
1. Changes by Customer: If you wish to make changes to your booking, please contact us as soon as possible. We will do our best to accommodate your request but cannot guarantee that changes will be possible. Additional fees may apply.
2. Changes by Company: We may need to make changes to the itinerary, accommodations, or other aspects of the Travel Package due to unforeseen circumstances. We will notify you of any significant changes as soon as possible and make reasonable efforts to provide alternatives of equal or greater value.
5. Liability and Disclaimer
1. Limitation of Liability: Our liability is limited to the amount you have paid for the Travel Package. We are not responsible for any indirect, incidental, or consequential damages arising from your participation in our Travel Packages.
2. Force Majeure: We are not liable for any failure to perform our obligations under these Terms due to events beyond our control, including but not limited to natural disasters, war, civil unrest, or government actions.
3. Third-Party Providers: We work with third-party providers to offer certain services as part of the Travel Package. While we make every effort to ensure the quality and reliability of these providers, we are not responsible for their actions or omissions.
6. Travel Insurance
We strongly recommend that you purchase comprehensive travel insurance to cover potential risks, including trip cancellation, medical emergencies, and loss or theft of personal belongings.
7. Conduct and Responsibilities
1. Conduct: You are expected to conduct yourself in a respectful and lawful manner during your participation in our Travel Packages. We reserve the right to remove any participant whose behavior is disruptive or harmful to others.
2. Responsibilities: You are responsible for your personal belongings, safety, and adherence to local laws and customs during your trip. We are not liable for any loss, damage, or injury resulting from your actions or negligence.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state of Delaware. Any disputes arising from or related to these Terms or our Travel Packages will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
9. Amendments
We reserve the right to amend these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the revised Terms.
